BIR files tax evasion raps vs. contractor, manufacturer - GMA Network

The Bureau of Internal Revenue on Thursday filed tax evasion charges before the Department of Justice against the owners and accountants of a construction company and a plastics manufacturer.

In a filing under its Run After Tax Evaders program or RATE, the bureau filed a complaint against Paulino Go Pe, owner of construction firm Archipelago Builders.

A BIR assessment showed Pe incurred tax deficiencies of P306.97 million from 2008 to 2010.
?
His accountant, Ma. Teresa Garcia, was also charged for violating Section 257 of the National Tax Code for certifying Pe?s financial statements, which the bureau claimed were falsified.
?
BIR records showed Pe earned about P644.50 million from his clients including SM Investments Corp., Zuellig Pharma Corp., and Vista Residences Inc., among others.

However, the bureau alleged that there was ?substantial under declaration of sales [of] more than 30 percent in the years in question.?

Pe?s daughter, Angelina Pe-Dizon ? the contractor?s office manager ? noted they have yet to receive a notice on the tax BIR complaint.

?Wala pa kaming alam dito. Wala pang formal notice or confirmation,? Dizon told GMA News Online on Thursday.

?Kaka-receive pa lang naming ng letter of authority [mula sa BIR pero] hindi pa nagsisimula ang examination? Nag-ga-gather pa lang kami ng lahat ng documents,? she added.

The bureau is also running after PhilPackaging Corporation president Camino Benedicto and treasurer Juanito Benedicto for tax evasion, value added tax evasion, and failure to supply correct information in their annual income tax returns for 2009.

PhilPackaging makes and trades plastic woven cloth and bags.
?
BIR claimed PhilPackaging has a tax deficiency of P72.66 million in 2009.
?
This is not the first time the bureau has filed a complaint against PhilPackaging.
?
Late last month, the bureau filed a separate complaint against the company for a P50-million tax deficiency in 2010.

The complaints lodged at the Justice Department were the 130th and 131st filed under the BIR RATE program. ? Rouchelle Dinglasan/VS, GMA News
